What is the default process for the compliance check?
Even though each identified compliance concern requires its own assessment of urgency, the following standard process is proposed:
STAGE I: Off site assessment
- Preliminary assessment
- Signing a confidentiality agreement
- Scope assessment
- Signing contractual agreement
- Down payment
- Defining dates for on site assessments
STAGE 2: On site assessment
- Phase I: Knowledge transfer
- Phase II: Root cause analysis
- Phase III: Presenting proposed resolution
At first a preliminary assessment is made off site to ensure that the compliance concern will have an association with outbound logistics. Then a confidentiality agreement will be signed to ensure that all information can be shared in a safe environment. Furthermore, it is important to discuss the expectations of the compliance check by means of a contractual agreement. Finally a down payment is negotiated as that would be a clear signal that there is a commitment to solve any potential compliance concerns.
As soon as the down payment has been received, the dates for the on site attendance will be formally agreed. The on site presence is split over three phases, being a) knowledge transfer, b) root cause analysis and c) resolution proposal.
By default the knowledge transfer should take 2 full working days, whereas the root cause analysis takes another 2 days and one final day for presenting the proposed resolution. Depending on the urgency, these visits can be spread over a period of maximum 3 weeks.
The final payment will be initiated after presenting the resolution. The normal terms of payment for this final payment will be 30 days net, with a 2% discount when paid within 15 days.
